Property Division

How Should Marital or Joint Property be Divided?

Almost every dissolution involves division of property. When dividing marital property in Oregon or Washington State, the court presumes that each spouse or partner made an equal contribution to the marriage. Talk to a divorce lawyer about what marital property or joint property is and how it will likely be divided in your particular case. Call an attorney at Beth Allen Law PC in Portland, Oregon.

Generally, the best way to deal with marital property division is by agreement between the spouses or partners. Our law firm can guide you through the decision-making process to assure the property division is fair and equitable.

  • If you cannot agree: A fight about marital property or partner property division can be expensive and time-consuming. If the spouses or partners cannot agree, then the judge will make the decision. At our law firm, we have the skills needed for persuasive negotiations as well as effective litigation.
  • Spousal/Partner support: If your divorce includes spousal support (alimony) or partner support, that can be a factor in property division.
  • Marital property: Any property acquired during a marriage or a Registered Domestic Partnership is presumed to be marital or joint property, with some exceptions. Such marital property or joint property includes the family home, a second home, other real property, money, retirement benefits, investments, IRA accounts, 401(k) accounts, cars, pets, jewelry and other personal property. For Registered Domestic Partners, these issues can be especially complex.  Talk to your attorney about what a fair division of property would be in your divorce or dissolution.
  • The objective: Marital property division should be a mechanism that leaves both spouses with the standard of living they enjoyed during the marriage. While that cannot always be attained, it is the goal.  The attorneys at Allen2 Law can help you attain that goal.
